Terms and Conditions of Sale

These Terms and Conditions of Sale govern all contractual relations between Dafotec SAS and the Client, whether a consumer or a professional. They set out the purpose of the services, the course of the free diagnosis and the quote, the return of data, the definition of success (best-efforts obligation), payment and the governing law.

Preamble

FlashData® by Dafotec's services consist of diagnosing, analysing and recovering the data held on faulty or damaged digital storage devices.

Given the nature of the devices handled and their sometimes severely degraded condition, FlashData® by Dafotec undertakes to implement all the technical and human means reasonably necessary to recover the data, without being able to guarantee complete recovery in every case.

Any order implies full and unreserved acceptance of these Terms and Conditions of Sale.

Article 1 — Purpose of the service

FlashData® by Dafotec provides the following services:

  • diagnosis of digital storage devices;
  • data recovery;
  • logical reconstruction of storage volumes;
  • work on RAID systems, NAS and servers;
  • handling of devices requiring intervention in a controlled environment.

The service does not include:

  • reinstalling operating systems;
  • software configuration;
  • returning equipment to service;
  • rebuilding business applications.

Assistance with reintegrating the recovered data may be offered depending on the case.

Article 2 — Diagnosis and quote

The diagnosis is carried out free of charge.

Following the diagnosis, a detailed quote is sent to the Client setting out:

  • the nature of the fault identified;
  • the operations envisaged;
  • the estimated lead time;
  • the cost of the service.

Some complex interventions may require specific technical resources to be committed as soon as the quote is accepted (controlled environment, advanced research, reconstruction engineering or work on components).

Where this is the case, the quote clearly distinguishes between:

  • the technical operations undertaken from the outset;
  • the data-recovery operations.

The applicable financial terms are set out in the quote accepted by the Client.

No chargeable work is carried out without the Client's prior agreement.

Article 3 — FlashData® by Dafotec's undertakings

FlashData® by Dafotec undertakes to:

  • provide a prior quote;
  • keep the Client informed of the progress of their case;
  • process the data on a strictly confidential basis;
  • use the technical methods suited to the condition of the device;
  • return the recovered data on a suitable device.

Article 4 — Lead times

The lead times communicated are estimates.

Depending on the nature of the fault and the complexity of the case, lead times may be extended where this is necessary for the proper performance of the service.

Article 5 — Return of data

The recovered data is returned on a USB device supplied by FlashData® by Dafotec or on any other device agreed with the Client.

A list of the recovered data may be provided to the Client before final validation of the service where this is technically possible.

Article 6 — Definition of success

Data recovery is a best-efforts obligation.

The service is deemed performed once the technically recoverable data has been extracted and made available to the Client.

FlashData® by Dafotec cannot guarantee that all of the sought-after data was present on the device at the time of intervention, as it may have been deleted, overwritten, altered or destroyed before the device was taken in.

Article 7 — Encrypted devices and access

The Client must provide the passwords, encryption keys or information necessary to access the data.

FlashData® by Dafotec does not bypass any security or encryption mechanisms.

The absence of information enabling access to the recovered data cannot call into question the performance of the service.

Article 8 — Payment

Unless otherwise specified in the quote, the services are payable in cash.

The recovered data is returned after full settlement of the invoice.

FlashData® by Dafotec may exercise a right of retention over the equipment, the recovered data and the return devices until full payment of the sums due.

Article 9 — Storage of equipment

From the closure of the case, the Client has a period of three months to request the return of their equipment.

After this period and following a reminder that has gone unanswered, FlashData® by Dafotec may recycle or destroy the device in accordance with the applicable confidentiality rules.

Article 10 — Confidentiality

FlashData® by Dafotec applies a strict confidentiality policy.

The data entrusted is accessible only to authorised staff working on the case.

No data is subject to commercial exploitation or disclosure to third parties except where required by law.

Article 11 — Personal data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

The Client has a right of access, rectification, objection, restriction and erasure of the data concerning them.

Article 12 — Liability

The Client acknowledges that the device entrusted may be seriously damaged before intervention.

Given the nature of recovery operations, certain handling may cause further degradation of the device.

FlashData® by Dafotec implements the precautions reasonably necessary to limit this risk.

Save in the event of gross negligence or wilful misconduct, FlashData® by Dafotec's overall liability is limited to the amount actually paid by the Client for the service concerned.

FlashData® by Dafotec cannot be held liable for loss of business, indirect financial loss, loss of turnover or consequences linked to the absence of a prior backup.

Article 13 — Delivery and complaints

Any delivery discrepancy must be reported within seven days of receipt.

FlashData® by Dafotec keeps a security copy of the recovered data for a maximum of fifteen days after delivery, unless the Client requests otherwise.

Article 14 — Right of withdrawal

For consumer Clients, the right of withdrawal is governed by the applicable consumer-protection provisions.

Where the Client requests immediate performance of the service before the statutory withdrawal period expires, they acknowledge that this right may be lost in accordance with the applicable legal provisions.

Article 15 — Mediation

In accordance with the applicable consumer-protection provisions, any consumer Client may use a consumer mediator free of charge after first submitting a written complaint to FlashData® by Dafotec.

Article 16 — Governing law

These Terms and Conditions of Sale are governed by French law.

For professional Clients, the courts of Lille Métropole shall have exclusive jurisdiction.

Consumer Clients benefit from the rules of jurisdiction provided for by the applicable consumer-protection law.

Last updated: 2026. The Terms and Conditions applicable to an order are those in force on the date the Client accepts the quote.
